The highest bidder shall be the purchaser, should a dispute arise between the bidders or any mistake be made, the Auctioneer may either declare the purchaser or re-offer the lot.

The advance in the bidding shall be regulated by the Auctioneer.

The Auctioneer, who will be sole arbiter in the matter of any dispute or mistake, reserves the right to refuse any bid, or bid on behalf of the vendor, in the case of any lot or lots, upon which there is a reserve, or to withdraw, consolidate or divide any lot or lots with regard to the position of the same in the catalogue.

Each and every lot shall, upon the fall of the hammer, be at the sole risk of the purchaser, and no lot or lots may be removed during the sale, and in any case, no lot or lots may be removed until a receipted invoice has been checked.

All descriptive statements contained within the advertisements or catalogue or made by the Auctioneers or any member of their staff before or at the time of the sale are to be taken as expressions of the vendor’s and Auctioneer’s opinion and not as warranties, and no warranty of any kind to be applied.  It is to be assumed that the purchaser has inspected the lots he buys and in any event no compensation shall be paid for the same.

Chilcotts, Auctioneers & Valuers, act as agent only and neither they nor the vendor are responsible for any faults or defects of any lot, of any correctness of any statements contained in the catalogue, advertisements or brochures of any forthcoming sales.

RESCISSION - Notwithstanding any other terms of these conditions, if within three weeks after the sale the buyer of any lots serves formal notice alleging that the lot is a deliberate forgery and returns the lot to the Company in the same condition at the time of the sale and produces evidence acceptable to the Company that the lot is a deliberate forgery, then the sale of the lot will be rescinded. The Company will reimburse the buyer for the amount paid for the lot within seven days of the vendor refunding to the Company the net proceeds of the sale. Any dispute between vendor and buyer relating to goods consigned to the Company for sale, including rescission which cannot be settled by agreement shall be settled by an arbitrator appointed by the President of the Royal Institution of Chartered Surveyors. The vendor and the buyer shall be bound by the decision of the arbitrator including the incidence of costs.

Unless otherwise stated, all lots must be paid for and collected from the salerooms by 1:00pm on the Friday after the sale.  Failure to comply with this condition may result in the lot or lots being re-sold by public auction or private treaty and the deficiency (if any) together with all charges attending the same shall be made good by the defaulter.  Any profit resulting from such a re-sale shall belong to the vendor.
